$5 Million Settlement in Garbage Truck Accident Case
Recently, Power Rogers & Smith attorneys Joseph A. Power, Jr. and Jonathan M. Thomas reached a settlement agreement with Flood Brothers Disposal Company for $5,000,000 in a case involving a garbage truck which struck and injured an 80 year-old unmarried woman. The Plaintiff was in a crosswalk crossing Harlem Avenue at the intersection with Ontario Avenue, in Oak Park, when the Flood Brothers garbage truck made a left hand turn onto Harlem Avenue, failed to yield to the Plaintiff and struck and ran over the Plaintiff.
The Plaintiff suffered multiple injuries, her most serious injury was a degloving injury to her right leg which ultimately required a transfemoral amputation.
Due to the extensive injuries suffered by the 80 year old Plaintiff she was unable to return to her home that she had lived at for many years in the Oak Park community, as she has no surviving heirs, she was forced to be admitted to a senior living facility and remains there today.
“This settlement will enable the Plaintiff to obtain the attention, medical care, and therapy she now requires as a result of this tragic occurrence,” said Joseph A. Power, founding partner of Power Rogers & Smith.
The case had been pending since 2014 in front of the Honorable Moira Johnson in the Circuit Court of Cook County.
