Smith & LaCien Recover $8 Million for Couple Injured in Motorcycle Crash

Todd Smith and Brian LaCienAttorneys Todd A. Smith and Brian LaCien represented a Barrington Hills couple in a motorcycle collision case and obtained an $8,000,000 settlement.

A Barrington Hills couple sought counsel with Todd A. Smith and Brian LaCien of Power Rogers & Smith, L.L.P. after a serious motorcycle collision that occurred on May 29, 2010. After 2.5 weeks of trial before Judge James M. McGing, a settlement was reached on November 18, 2015.

Both plaintiffs were riding the motorcycle at the time of the collision. They were on a Memorial Day weekend ride to Northwest Illinois and back. The motorcycle was traveling eastbound on Route 176 in Marengo, Illinois when they were impacted by an Audi that had just been rear-ended by a work van.

The Audi and van were traveling westbound on Route 176. The Audi was waiting to turn left, but the driver had the wheels turned left while stopped, so that upon impact, the Audi was pushed directly into the oncoming motorcycle, ejecting the riders. Sadly, at the time of the crash, the couple was on the last 30-minute leg of their eight-hour journey home.

Evidence was introduced that revealed the driver of the work van was up until 2:00am the night before, and got up at around 6:00am for work. This meant that he was operating on only four hours of sleep.

The husband was airlifted to Rockford Memorial Hospital and the wife was airlifted to St. Anthony’s in Rockford. Doctors diagnosed the wife with a T11 burst fracture. She continued to suffer pain because of the injury, which could require surgery in the future. Doctors at Rockford Memorial diagnosed the husband with left acetabular fracture and a left arm humerus fracture. Because of his injuries, he was no longer able to perform his job duties, and may eventually need joint replacement.

Although we wish we could have met these clients under happier circumstances, it was a true pleasure to represent them. They remained positive throughout the process, despite their injuries.
